Taiwan Provincial High Court Vacates Original Bail Rulings in the Hung Case

The Taiwan Provincial High Court vacated last Friday the High Military Court’s August 8 rulings to release on bail the three main suspects in the case involving the tragic death of Army Corporal Hung Chung-chu (洪仲丘) and remanded the case to the Taoyuan District Court (桃園地方法院) for a new ruling.
The Hung case, in which Hung died of heatstroke after being forced to do excessive drills in the stockade, was transferred to the jurisdiction of civil courts after the amendment bill to the Code of Court Martial Procedure (軍事審判法) became effective on August 15.
The Taiwan Provincial High Court vacated the High Military Court’s bail rulings because the collegiate bench concluded that the three suspects were likely to collude with others.
On August 8, the High Military Court let stand its August 1 bail ruling to release on bail Col. Ho Chiang-chung (何江忠), deputy commander of the 542nd Brigade; Maj. Hsu Hsin-cheng (徐信正), commander of the Brigade Headquarters Company; and Sergeant Fan Tso-hsien (范佐憲).
However, the military prosecutors filed interlocutory appeals with the Supreme Military Court against the High Military Court’s bail rulings.
The Taoyuan District Court stated that it would set a date today for a new detention hearing.
