 Farglory Wins Court Decision to Resume Partial Work on Taipei Dome

Taipei City Hall ordered a halt to all construction on the Taipei Dome BOT project in May last year, citing the fact that the Farglory Group (遠雄集團), the contractor which won the public tender for the construction of the Taipei Dome, “neglected public safety.” However, the Farglory Group filed a preliminary injunction with the Taipei Administrative High Court last June, requesting that the administrative court rescind the city government’s order. 

In July, the Taipei Administrative High Court ruled in favor of Farglory, stating that the contractor may resume necessary work in order to prevent public safety risks. Taipei City Hall then filed an interlocutory appeal to the Supreme Administrative Court against the lower court’s ruling. 

Yesterday, the Supreme Administrative Court rejected City Hall’s appeal, so Farglory can resume partial work. The ruling is final. 

The Supreme Administrative Court’s ruling noted that based on the principle of trust, Farglory and Taipei City Hall should hold discussions on a range of safety issues in order to resume construction on portions of the dome that were vulnerable to collapse or posed a public safety hazard. The ruling stressed that time was of the essence in protecting public safety in the vicinity of the Taipei Dome. 

Farglory spokesman Jacky Yang (楊舜欽) stated that Farglory welcomed the ruling and hoped that discussions with Taipei City Hall would be based on “professionalism” and the court’s ruling. Taipei City Hall stated that it respected the ruling, adding that the city government insisted that concerns over public safety were still its top priority.
