 Court Grants Preliminary Injunction Against IGPASC, Halting Confiscation of NWL Assets

The Ill-gotten Party Assets Settlement Committee (IGPASC) under the Cabinet issued an administrative disposition against the National Women’s League (NWL), determining that the NWL was a KMT-affiliated organization, and that its assets totaling NT$38.7 billion (approx. US$1.26 billion) were ill-gotten party assets, so the IGPASC demanded that the NWL revert the assets to the nation’s coffers.

The IGPASC then asked the NWL to transfer the assets to a designated account by April 18, or the former would “forcibly execute” the administrative disposition immediately in accordance with the law. The NWL thus urgently filed a petition for preliminary injunction with the Taipei High Administrative Court against the IGPASC’s administrative disposition.

Yesterday afternoon, the Court granted the NWL’s petition at the last moment before the forcible execution by the IGPASC on the grounds that this case involved urgency, that irreparable harm would be caused once the administrative disposition was executed, and that granting the preliminary injunction would not cause a severe impact on public causes. An interlocutory appeal against the ruling may however be filed.
