  Judicial Yuan President Finally Expresses Support for Judges

In mid-December last year, it was reported that Control Yuan member Chen Shi-meng (陳師孟) planned to ask Tang Yueh (唐玥), the trial judge who had acquitted former President Ma Ying-jeou in the secrets leaking case at the Taipei District Court, the court of first instance, to come in for an interview in order to investigate her legal opinions, eliciting a backlash from the legal circles. Yesterday, one month later, Hsu Tzong-li (許宗力) , president of the Judicial Yuan, finally expressed his opinions on the matter for the first time, pointing out that if Chen, as a Control Yuan member, brought in the trial judge for an interview on the grounds that her legal opinions were allegedly inappropriate, the rule of law would be undermined, and “the dividing line between democracy and an authoritarian regime in Taiwan would vanish noiselessly.”

Hsu went on to say that should the judicial system fail to hold fair trials and safeguard the minority, democracy under the ROC’s constitutional government would be tantamount to an existence only in name. Hsu urged all Constitutional organs to respect legal opinions on individual cases made by judges based on the judicial power in order to safeguard the hard-earned independence of the judiciary. 

According to informed sources, Chen Shi-meng originally planned to bring in Tang Yueh for an interview on January 16, a date after the 2020 general elections. However, after discussions with Kao Yung-cheng (高涌誠), the other Control Yuan member, who joined Chen as a team in the investigation, Chen decided to consult with constitutional scholars first in order to clarify the misgivings involved, postponing Tang’s interview.
