Due Process Disputes in Confirmation over CY Nominees: Opposition Caucuses to Jointly Petition CGJ for Judicial Review on Constitutionality of Result

Newly-confirmed Control Yuan members are slated to be sworn in on August 1. However, disputes have risen about due process in the confirmation over their nominations as the DPP caucus, relying on its numerical superiority, adopted a motion to directly vote on confirmation over the nominees for the Control Yuan in a plenary legislative session, skipping the review session to interpellate Control Yuan nominees. Thus, the KMT, the Taiwan People's Party (TPP), and the New Power Party (NPP) separately expressed their plans to file a petition with the Council of Grand Justices (CGJ) of the Judicial Yuan for a judicial review on the constitutionality of the confirmations in question.
Yesterday, the TPP fired the first salvo to make public its petition for judicial review, and expressed its resolve to strive for gathering enough co-sponsors, i.e. the minimum requirement of 38 legislators. The TPP also planned to petition the CGJ to temporarily freeze the functions and authority of the new Control Yuan members, pending the outcome of the judicial review.
Lin Wei-chou (林為洲), KMT party whip, stated that the KMT caucus’ draft petition for a judicial review had been completed, and would be filed with the CGJ next week. Lin extended a welcome for the TPP to co-sponsor the KMT caucus’ petition.
NPP party whip Chiu Hsien-chi (邱顯智) stated that in as much as various opposition caucuses had misgivings over the due process of the legislative proceedings, they should jointly petition a judicial review on the constitutionality of the matter under the name of the Legislative Yuan.
