The case of Hong Kong murder suspect Chan Tong-kai has undergone twists and turns; the Mainland Affairs Council (MAC) recently indicated that our Criminal Police Bureau and the Hong Kong Police Department have erected an ad hoc window of liaison for Chan’s surrender. We hope that there won’t be further political reverberations between Taiwan and Hong Kong, allowing the Chan Tong-kai case to return to the arena of criminal justice, resolving the humanitarian crisis and disaster of human nature elicited by political calculations.

 

At the end of last month, when Premier Su Tseng-chang vehemently lambasted Ma Ying-jeou and his "bosom friend lawyer" as well as the "Political Consultative Conference pastor" as "the devil and the devils within the devil", it aroused strong criticisms from legal circles. The Tsai government has not stopped framing and smearing Ma Ying-jeou and C.V. Chen, nor would it believe Peter Koon’s rhetoric of apology. However, Chen Shui-bian, nevertheless said, "Peter Koon, a delegate to the Beijing National Political Consultative Conference was accompanied by a National Policy Advisor to the President to call on the Interior Minister, yet the Minister nevertheless said that he had no prior knowledge of Koon’s other identity; the credibility of this story was nearly zero."

 

Chan Tong-kai was willing to surrender himself, and the Tsai government, which was shocked and panicked to the extent of not knowing what to do, told a series of lies. From confusion in logic to chaotic words, the people of course have their views on the "credibility." Nevertheless, based on the perception of "devils", the Tsai government sketched a "one-China framework" trap that dwarfed Taiwan's sovereignty, as well as a group of devils selling out Taiwan, and on this basis, directed the handling of the case, intervening in judgment, undermining the rule of law, pinning fellow traveler labels, pan handling the sense of losing one’s country, eventually ending up eliciting a humanitarian crisis and disaster of human nature.

 

Su Tseng-chang "deeply felt weird": after being released from prison in Hong Kong, Chan Tong-kai could live as a free man; why didn’t he enjoy the freedom in Hong Kong? Instead, Chan suddenly wanted to come to Taiwan to face trial in a murder case; this did not conform to human nature. Hsu Kuo-yung also said that Hong Kong had no death penalty, but Taiwan had, adding that the defendant could be tried in Hong Kong, but he wanted to be tried in a place where there was capital punishment; this did not conform to human nature. A man who only sees devils in his eyes cannot see the redemption of human nature. Especially, Su Tseng-chang said in the open that when the death penalty was handed down on final appeal, it would be executed. Politics directing the handling of the case, instructing judgment, and even taking advantage of a bloody case, these are indeed the devils within the devil. This is not equal justice before the law, but a disaster of humanity by playing with the criminal justice system and trampling on justice.

 

The DPP has for long supported the repeal of the death penalty, but in order to scare and deter Chan Tong-kai from surrendering himself in Taiwan, the DPP continues to harvest the dividends from the protests and demonstrations over the amendment bill to the Fugitives Offenders Ordinance, thus Su Tseng-chang again attempted to use the death penalty as a tool. However, if the death penalty is erected on the foundation of political calculations and electoral benefits, then together with those who would be executed by the firing squad of the Tsai government would also include judicial jurisdiction, independence of the judiciary, humanitarian values ​​and the dignity of human nature.
